Bloomberg covers one of the bigger problems with fracking. The water they inject into the old coal mines isn’t really water; it is a chemical mix that is considered a trade secret. That would make it difficult for courts to assess damages caused by the chemical mix. I think this is easy to overplay -water is a chemical, too- but the gains in incentives bred by keeping the chemical components a trade secret is probably minimal as well. Regulations here aren’t likely the worst thing in the world. Of course, one of my few publications is on fracking, and you can see more about how I feel there.

Are ethanol rules that big of a deal? Sounds plausible. I don’t know.
